How MedMost Supports Your Case

 

In medico-legal work, the quality of the expert evidence can be critical to the outcome of a case. At MedMost, our role as a Medical Reporting Organisation is to ensure that solicitors are matched with the right medical expert, that instructions are handled efficiently, and that reports are delivered on time and in compliance with the relevant legal requirements.

Finding the Right Expert

The first and often most important stage is identifying the appropriate expert witness for the case. This is more demanding than it may first appear. In clinical negligence matters, for example, the legal test often depends on what a responsible body of similar professional clinicians would consider to be acceptable practice. It is therefore essential that the expert’s clinical background, current or recent practice, and specific area of expertise closely match the issues in dispute. Many expert witness clinicians have highly specialised areas of knowledge. A consultant’s job title alone is rarely enough. The expert must have the right experience for the precise clinical questions being asked.

Checking Suitability, Availability and Conflicts

Once a suitable expert has been identified, we contact them to confirm their availability, timescales and fees. We also check that they are not conflicted and that they have the necessary medico-legal experience. Where required, we ensure that the expert understands their duties under Part 35 of the Civil Procedure Rules, including their overriding duty to the court. This helps solicitors instruct experts with confidence, knowing that the expert is not only clinically appropriate, but also familiar with the standards expected in medico-legal reporting.

Managing the Instructions and Records

After the expert has been confirmed, we receive the medical records and letter of instruction from the solicitor. We then securely provide the relevant documentation to the expert and remain the point of contact throughout the reporting process. This includes liaising with the expert, answering administrative queries, monitoring progress and keeping the solicitor informed. We reduce the administrative burden on solicitors while ensuring that the expert has everything required to prepare a thorough and reliable report.

Ensuring Timely, Compliant Reports

A medico-legal report must be clear, balanced, properly reasoned and compliant with the relevant procedural requirements. We work with the expert to ensure that reports are delivered within the agreed timeframe and that they meet the expected standards, including CPR Part 35 compliance where applicable. Before delivery, we check that the report addresses the questions raised in the letter of instruction, is appropriately structured, and includes the necessary declarations and expert witness statements.

Our inclusive administration fee is never more than 25% of the expert’s fee, and we provide the expert’s fee note so your costs position is clear and defensible on assessment. Most reports are delivered within 14 days of receiving instructions and medical records.

For solicitors, instructing the right expert is not simply an administrative step. It can influence the strength, direction and value of a case. A poorly matched expert, delayed report, or non-compliant opinion can cause unnecessary difficulties, additional costs and avoidable delay.
